Personal Data Processing Policy

Rules governing the processing of personal data by W rent, s. r. o.

The protection of your personal data is an important element in the development of the systems and procedures used by our company. This policy explains how W rent, s. r. o., with its registered office at Prečín 277, 018 15 Prečín, Slovakia, Company ID No.: 46 908 668, registered in the Commercial Register of the District Court Trenčín, Section Sro, Insert No. 27314/R, processes your personal data when providing our services.

We emphasise that our company is committed to continuously improving its personal data protection policies, procedures and security systems and, for this purpose, to updating and enhancing them as appropriate. In order to ensure effective protection of personal data, we obtain and apply the latest available knowledge and practices.

When processing personal data, we are primarily governed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), as well as Act No. 18/2018 Coll. on Personal Data Protection.

Our employees and other persons involved in our activities are required to maintain confidentiality regarding all information and documents relating to our customers.

1. What Is Personal Data?

Personal data means any information on the basis of which you can be identified, either directly or indirectly. Personal data may therefore include, for example, your first name, surname, address or telephone number.

The GDPR also recognises special categories of personal data that require particularly sensitive handling. Special categories of personal data include, for example, data concerning racial or ethnic origin, political opinions, religious beliefs, trade union membership, genetic data or health data.

Our company does not intend to process special categories of personal data relating to customers. If such data has been provided to us, please contact us so that we can delete it, unless we are prevented from doing so by law.

A special regime also applies to the personal data of minors. We do not intentionally process such data except where required by law. If you become aware that we have obtained such data, please contact us.

2. Why Do We Process Personal Data?

Processing of personal data means any operation or set of operations performed on personal data, such as collection, organisation, storage, retrieval, consultation, use, dissemination, deletion or destruction, regardless of whether such operations are performed by automated or non-automated means.

We process your personal data primarily so that we can provide our services and fulfil our legal obligations.

In addition, we process your personal data where required by the applicable laws of the Slovak Republic or where necessary to protect the legitimate interests of our customers, our company or other persons.

photographs or video recordings from installations, assembly work or servicing of our products at our customers’ premises, which may be used to promote our goods and services, for example by sharing them on our website and social media channels

dynamic or static recordings from cameras monitoring the area in front of our premises as well as the interior of the premises, made for the purpose of protecting property and the safety and health of employees

personal data such as company name, email address and telephone contact obtained from voice recordings from our information line, made for the purpose of improving services for our customers

personnel and payroll administration compliance with legal obligations, legitimate interests or performance of a contract in the field of employment law, social security and social protection, for example under the Labour Code; detailed information will be provided to each employee when entering into an employment contract title, first name, surname, date of birth, permanent address, temporary address, personal identification number, job position, employment start and end dates, information relating to employee education and professional development, and other information required by the applicable laws of the Slovak Republic

4. Who Do We Disclose Your Personal Data To?

We disclose personal data, whether belonging to our employees, customers or third parties, only to those persons and only to the extent necessary to fulfil our legal obligations and provide our services. At the same time, we ensure that recipients are reliable entities that comply with their legal obligations, and we enter into agreements with them containing appropriate commitments to protect your personal data.

We also disclose your personal data, solely to the extent necessary, to processors with whom we have entered into written agreements for the protection of personal data, such as our legal representatives, IT technicians, providers of software solutions or technical and security support, as well as transport companies that deliver our goods directly to you. If we disclose your personal data to such recipients, we will provide you with a specific list upon request, provided that applicable law allows us to do so.

Some of your personal data may also be shared publicly on our website or on social media, including the “W rent” Facebook page, the “W rent” Instagram profile, the “W rent” LinkedIn account or YouTube. Publication is based on our legitimate interest in promoting our goods and services or, in certain specific cases, on your consent.

Your personal data is collected by the companies listed above in accordance with their own personal data processing policies and your settings on the relevant social network and browser. We have no control over these circumstances. If you are interested in information that we publish on these social networks but do not want your personal data to be processed in this way, please contact us at any time and we will provide the information in another form.

We also draw your attention to the fact that we are required to prevent or report the commission of criminal offences and are also subject to reporting obligations in relation to the prevention of money laundering and terrorist financing. In such exceptional cases, the personal data concerned may also be shared with law enforcement authorities.

5. To Which Countries Do We Transfer Your Personal Data?

We do not transfer your personal data to third countries outside the European Economic Area (EU, Iceland, Norway and Liechtenstein). We use secure cloud services provided by a verified provider with servers located within the EU.

Please note, however, that if you visit our “W rent” group on Facebook, our “W rent” group on Instagram, our “W rent” LinkedIn account or our YouTube account, your personal data will be collected by the companies specified in points 4.4.1–4.4.4 of this Policy in accordance with their personal data processing policies and your settings. Their storage facilities and servers may also be located in the United States of America. We have no control over these circumstances. If you are interested in information that we publish on these social networks but do not want your personal data to be transferred outside the European Economic Area in this way, please contact us and we will provide the information in another form.

6. How Long Do We Retain Your Personal Data?

We retain personal data only for as long as necessary for the purposes for which it is processed, unless the applicable laws of the Slovak Republic require us to retain it for a longer period, for example for handling and accepting complaints, resolving legal disputes, archiving, fulfilling obligations relating to the prevention of illegal activities or complying with accounting obligations.

If we process your personal data on the basis of law, we retain it for as long as required by the relevant legislation. If the legislation does not specify a retention period, we retain your personal data for 5 years in case it is required to clarify or resolve any disputes.

If we process your personal data on the basis of a contract and the applicable laws of the Slovak Republic do not provide otherwise, we retain it for 5 years after termination of the contract in case it is required in judicial or other proceedings.

If we process your personal data solely on the basis of legitimate interest, we retain it for a maximum of 5 years from its last use, likewise in case it is required in judicial or similar proceedings, or until you successfully object to its processing.

If we process your personal data on the basis of consent, we will cease retaining it if you withdraw your consent or when the agreed validity period of the consent expires.

For CCTV recordings, the retention period is no more than 15 days from the date the recording was made.

We do not make audio recordings of our information line.

7. How Do We Obtain Your Personal Data?

We usually obtain personal data directly from customers, particularly when entering into a contract.

If you have contacted us through the contact form published on our website or through our information line, we obtained your personal data directly from you.

If you are one of our employees or another contractual partner, we primarily obtain your personal data directly from you when you apply for employment and when entering into an employment or other contract.

8. How Do We Use Your Data?

As stated in the table above, we collect only the personal data we need in order to provide you with high-quality services in accordance with applicable legislation. We protect your personal data and ensure that it is used exclusively for the purpose for which it was collected. Our employees who are authorised to work with your personal data are trained to ensure its protection. Therefore, if:

we required your personal data in order to enter into a contract or deal with your pre-contractual requests, we used it specifically for this purpose and in a manner permitted by law;

we obtained your personal data in order to comply with legal obligations connected with our activities, for example for invoicing and other accounting obligations, we use and process it in the manner prescribed by the relevant legislation;

we process your personal data on the basis of legitimate interest, you can be assured that it will be used solely for the purpose of pursuing that legitimate interest;

we hold your personal data because you have given us your consent, we process it for the purpose and in the manner specified in that consent, but only until you withdraw your consent.

We emphasise that our obligations also include cooperation with public authorities. If we are required to provide your personal data at their request or in proceedings before administrative or judicial authorities, we are entitled to process your personal data for these purposes as well.

9. Website and Cookies

The cookies used by the website do not collect any personal data. The use of our website is therefore not only secure but also fully respects your right to privacy and personal data protection.

For the purpose of statistical evaluation of website traffic, we use Google Analytics. Your IP addresses are anonymised and therefore cannot be used to identify you, as a result of which they are not considered personal data.

10. What Rights Do You Have as a Data Subject?

Right of Access

You have the right to obtain confirmation from us as to whether and how we process your personal data and, if so, what data we process and to whom it is disclosed. You may also request access to this data by submitting a simple request using the contact details provided at the beginning of this Policy. Please remember to identify yourself in your request and provide contact details to which we can send our response, such as your email address.

Right to Rectification

If you believe that any personal data we process about you is incorrect, you may ask us to correct it. You may also request that we complete data you consider incomplete. In such a case, please clearly and comprehensibly explain what you believe to be incorrect or incomplete, how you would like the information to be corrected and, where necessary, provide evidence demonstrating the inaccuracy.

Right to Erasure (Right to Be Forgotten)

You have the right to request that we delete personal data that we process about you, and in certain cases specified by law we are required to comply with such a request. Please note, however, that in certain circumstances the GDPR allows us to refuse a request for erasure, for example where processing is necessary for archiving purposes in the public interest, scientific research or statistical purposes, or for the establishment, exercise or defence of legal claims.

Right to Restriction of Processing

You have the right to restrict the extent to which we process your personal data if:

you have contested the accuracy of the personal data, until we have verified your objection;

the processing is unlawful and you oppose the erasure of the personal data and request restriction of its use instead;

we no longer need the personal data, but you require it for the establishment, exercise or defence of legal claims;

you object to the legitimacy of our interests in processing your personal data, until it has been verified whether our legitimate grounds override the legitimate grounds you have raised.

Right to Data Portability

You have the right to obtain your personal data from us in a commonly used format and transfer that data to another controller or processor. However, this right applies only to data for which you have given us consent to process or which is processed on the basis of a contractual relationship with you and is processed by automated means. This right may also only be exercised to the extent that it does not adversely affect the rights and freedoms of other persons.

Right to Object

In certain cases, you have the right to object to the processing of your personal data. This applies in particular to processing carried out on the legal basis of our legitimate interests, including profiling based on that legal basis, as well as, for example, the processing of personal data for scientific or historical research purposes or statistical purposes.

In practice, an objection to processing will usually arise if, for any reason, you disagree with the way in which we process your personal data, for example under this Policy. In such a case, you must inform us of your objection. Please provide a clear and comprehensible description of the circumstances on the basis of which you believe that the processing in question disproportionately interferes with your rights and freedoms.

Rights Relating to Automated Individual Decision-Making, Including Profiling

Our company does not carry out automated individual decision-making, i.e. decision-making without human intervention. If such decision-making were to take place, however, you would have the right to request not to be subject to such a decision where it produced legal effects concerning you or similarly significantly affected you.

Right to Lodge a Complaint

11. Changes to the Personal Data Protection Policy

Personal data protection is not a one-off matter for us. The information we are required to provide in relation to our processing of personal data may change or cease to be current. For this reason, we reserve the right to amend and update this Policy at any time and to any extent. If we make substantial changes to this Policy, we will notify you of the changes on this website or by email.
